These Terms & Conditions apply to your access to and use of the SiteKeepers Digital website, located at sitekeepers.com.au, and any enquiries, forms, content, resources, quotes, proposals, care plans, support services, or other services made available by SiteKeepers Digital.

By accessing or using this website, submitting an enquiry, requesting a quote, approving a proposal, or engaging SiteKeepers Digital for services, you agree to these Terms & Conditions.

Nothing in these Terms & Conditions excludes, restricts, or modifies any consumer guarantee, right, remedy, or protection you may have under the Australian Consumer Law or any other law that cannot legally be excluded, restricted, or modified.

SiteKeepers Digital provides website design, website rebuilds, WordPress website care plans, managed website support, hosting coordination, domain and DNS support, business email setup support, security checks, backups, monitoring, and related business technology support services.

In these Terms & Conditions:

"SiteKeepers Digital", "we", "us", or "our"
means SiteKeepers Digital.
"Website"
means sitekeepers.com.au.
"User", "you", or "your"
means any person who visits the website, submits a form, requests a quote, becomes a client, or uses our services.
"Client"
means a person, business, organisation, or authorised representative that purchases or engages SiteKeepers Digital for services.
"Services"
means website design, website care, hosting support, domain support, DNS support, email support, security, backups, monitoring, maintenance, consulting, and related services provided by SiteKeepers Digital.

Quotes, Proposals, Pricing, and GST

Any quote or proposal provided by SiteKeepers Digital is based on the information available to us at the time.

A quote may change if:

  • the project scope changes;
  • additional pages, features, integrations, content, revisions, or services are requested;
  • third-party costs change;
  • required information was incomplete or inaccurate;
  • unexpected technical issues are discovered;
  • the client's existing website, hosting, domain, DNS, plugin, email, or server setup requires extra work.

Unless stated otherwise, prices shown on this website are in Australian Dollars (AUD).

Where prices are displayed to the public, we aim to display clear total pricing, including GST where GST applies.

If SiteKeepers Digital is not registered for GST at the relevant time, GST will not be charged. If SiteKeepers Digital becomes registered for GST, applicable GST will be shown on relevant invoices, quotes, or pricing pages.

Note: Unless stated otherwise, third-party costs are not included in our website pricing. These may include hosting, domain names, email licences, premium plugins, paid themes, stock images, booking tools, payment processing fees, analytics tools, or other external platform costs.

Website Design and Build Services

Website build services may include planning, design, WordPress setup, theme development or configuration, page creation, form setup, mobile responsiveness, launch checks, and related tasks depending on the agreed package or proposal.

Unless specifically included in writing, website build services do not include:

Unlimited revisions
Copywriting for all pages
Professional photography or video production
Logo design or full brand identity design
Advanced SEO campaigns
Paid advertising management
Custom software development
Complex booking, membership, CRM, payment, or portal systems
Third-party licence fees
Ongoing support after the included support period
Hosting or email costs unless agreed separately

Any additional work outside the agreed scope may be quoted separately or charged at our standard hourly/project rate.

Website Care Plans and Maintenance

Website care plans may include services such as WordPress updates, plugin updates, theme updates, uptime monitoring, backup checks, security checks, small content edits, form testing, broken link checks, basic performance checks, reporting, and support time depending on the selected plan.

Care plans do not guarantee that a website will never experience downtime, errors, malware, plugin conflicts, hosting issues, email issues, or third-party service interruptions.

Care plans do not include unlimited work. Any monthly support time or edit allowance included in a care plan must be used within the relevant month and does not roll over unless agreed in writing.

Care plan work may be limited, delayed, paused, or refused where:

  • the website uses outdated, abandoned, nulled, pirated, unsupported, or malicious plugins/themes;
  • hosting access is restricted;
  • the client has not provided required access;
  • third-party systems are unavailable;
  • the website has been modified by another provider;
  • the issue is caused by hosting, domain, DNS, email, plugin, theme, or external platform problems outside our reasonable control;
  • the requested work falls outside the agreed care plan scope.

Support Hours, Response Times, and Urgent Work

Unless agreed otherwise in writing, SiteKeepers Digital's standard support hours are:

Monday to Friday, 9:00 AM to 5:00 PM Melbourne time, excluding Victorian public holidays.

Support requests received outside standard support hours may be reviewed on a best-efforts basis.

A response time is not the same as a resolution time. Some issues require investigation, third-party provider support, plugin developer support, hosting provider action, DNS propagation, client approval, or additional paid work before they can be resolved.

Emergency support, after-hours support, weekend support, malware recovery, urgent website restoration, urgent DNS fixes, urgent email troubleshooting, or urgent hosting issues may be subject to availability and additional fees.

Note: Unless a separate written service level agreement is agreed, we do not guarantee immediate response, same-day resolution, 24/7 uptime monitoring, or uninterrupted service availability.

Hosting, Domains, DNS, and Email Support

SiteKeepers Digital may assist with hosting, domains, DNS, SSL, Cloudflare, Microsoft 365, Google Workspace, email delivery, and related setup or troubleshooting.

Unless we are directly reselling or managing a service under a separate written agreement, third-party services remain provided by the relevant third-party provider.

You acknowledge that hosting providers, domain registrars, DNS providers, email providers, plugin vendors, payment gateways, booking platforms, analytics tools, and other external services may have their own terms, pricing, outages, support limits, renewal rules, and service availability.

We are not responsible for third-party outages, price changes, account suspensions, provider-side errors, expired domains, unpaid licences, or service interruptions outside our reasonable control.

Client Responsibilities

To allow us to provide services properly, clients must:

  • provide accurate business, website, hosting, domain, DNS, email, and login information;
  • provide required content, images, approvals, and feedback within reasonable timeframes;
  • keep third-party accounts, licences, hosting, domains, and email services paid and active;
  • maintain access to domain registrar, hosting, WordPress, Microsoft 365, Google Workspace, Cloudflare, and other relevant accounts;
  • notify us promptly of any website, email, hosting, or security issue;
  • avoid making major website changes during active development or support work unless agreed;
  • ensure they have permission to use any text, images, logos, videos, files, trademarks, or content supplied to us.

We are not responsible for delays, errors, loss, or additional costs caused by incomplete information, delayed feedback, missing access, unpaid third-party services, or unauthorised changes made by the client or another provider.

Access Credentials and Security

Clients may need to provide access to WordPress, hosting, domain registrars, DNS, email platforms, analytics tools, booking systems, or other platforms.

You are responsible for ensuring that all account access is authorised and that passwords, recovery emails, MFA methods, and ownership details are kept secure and up to date.

Where possible, you should provide secure delegated access instead of sharing personal passwords.

You must notify us immediately if you believe any account, website, email, or system has been accessed without authorisation.

Backups and Security

We may assist with backup setup, backup monitoring, restoration support, malware checks, security hardening, plugin updates, and related security services.

However, no backup system, security plugin, hosting platform, firewall, monitoring tool, or maintenance process can guarantee complete protection against data loss, downtime, hacking, malware, human error, plugin failure, server failure, or third-party compromise.

Clients should keep their own important business records, website content, media files, email records, login information, and critical documents backed up separately.

If a backup, security, or maintenance service fails to meet a consumer guarantee that applies under Australian Consumer Law, you may be entitled to a remedy under that law. Nothing in these Terms & Conditions removes those rights.

Third-Party Tools, Plugins, Themes, and Platforms

Many websites rely on third-party tools, including WordPress, plugins, themes, hosting platforms, domain registrars, DNS providers, email providers, payment gateways, booking systems, analytics tools, form plugins, security plugins, and backup plugins.

We are not responsible for:

Third-party bugs, vulnerabilities, outages, or service changes
Third-party pricing changes
Discontinued plugins, themes, or platforms
Plugin or theme conflicts
Loss of functionality caused by third-party updates
Limitations imposed by third-party providers
Account suspension or cancellation by a third-party provider

You must not knowingly install, upload, request, or use nulled, pirated, unlicensed, malware-infected, or suspicious software on a website or system we support.

If we reasonably believe that a website, plugin, theme, file, account, or system presents a security risk to SiteKeepers Digital, the client, other clients, hosting infrastructure, users, or third-party systems, we may suspend affected services, remove or quarantine suspicious files without prior client authorisation if they pose an immediate risk to system integrity, refuse to work on the affected component, or require remediation before continuing.

Where a third-party issue requires additional troubleshooting, replacement, migration, or repair work, additional fees may apply.

Payments and Invoices

Payment terms will be stated in the relevant quote, invoice, proposal, subscription, or service agreement.

Unless agreed otherwise:

Upfront deposits

May be required before work begins

Project milestones

May require payment before the next stage starts

Monthly care plans

Billed in advance

Overdue invoices

May result in work being paused

Service suspension

Services may be suspended if invoices remain unpaid

Third-party costs

May need to be paid before setup or renewal

If services are suspended due to non-payment, SiteKeepers Digital is not responsible for website downtime, missed updates, security breaches, data loss, plugin failures, expired licences, domain issues, email issues, or other problems that occur during the suspension period, except to the extent that liability cannot legally be excluded.

You remain responsible for all approved fees, third-party costs, subscriptions, licences, and renewals connected with your project or services.

Cancellations and Refunds

Nothing in this section excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Australian Consumer Law or any other law that cannot legally be excluded, restricted, or modified.

Project cancellations and refunds depend on the work completed, costs incurred, third-party fees paid, and the stage of the project.

If a project is cancelled after work has started, we may charge for work already completed, time spent, planning, design, development, meetings, research, setup, documentation, administration, third-party purchases, and any non-refundable external costs.

Monthly care plans may be cancelled by providing 14 days' written notice before the next billing renewal date, unless a different cancellation period is stated in your proposal, invoice, subscription, or service agreement.

Clients may submit cancellation notices via email to our support address or through any dedicated account dashboard provided by us.

Cancellation of a care plan does not automatically refund work already performed, the current billing period, third-party licences, third-party subscriptions, or external costs already incurred, unless required by law or agreed in writing.

If a service has a major failure under the Australian Consumer Law, you may be entitled to cancel the service contract and receive an appropriate refund or compensation under that law.

Australian Consumer Law

Our services come with guarantees, rights, and remedies that may apply under the Australian Consumer Law.

Nothing in these Terms & Conditions excludes, restricts, or modifies any rights that cannot legally be excluded, restricted, or modified.

Where we are legally permitted to limit liability, our liability is limited to one or more of the following:

Supplying the services again
Paying the cost of having the services supplied again
Another remedy required by applicable law

Reasonable Limitation of Liability

Nothing in this section excludes, restricts, or modifies any consumer guarantee, right, remedy, or protection you may have under Australian law.

To the maximum extent permitted by law, SiteKeepers Digital is not liable for indirect, incidental, special, consequential, or economic loss, including loss of profits, revenue, business opportunity, goodwill, data, rankings, traffic, enquiries, advertising performance, or reputation.

Subject to any rights or remedies that cannot legally be excluded, restricted, or modified, SiteKeepers Digital's maximum aggregate liability for claims connected with the services is limited to the total fees paid by the client to SiteKeepers Digital for the affected service in the three months immediately before the event giving rise to the claim.

This limitation does not apply where liability cannot legally be limited, including where Australian Consumer Law requires a different remedy.

We are not liable for loss or damage caused by:

Third-party hosting, domain, DNS, email, plugin, theme, or platform issues
Client error or unauthorised changes
Missing, incorrect, or delayed client information
Expired domains, unpaid subscriptions, or cancelled accounts
Malware, hacking, spam, phishing, or security incidents outside our reasonable control
Search engine ranking changes
Social media, advertising, or platform policy changes
Force majeure events or issues beyond our reasonable control

Intellectual Property

Unless agreed otherwise in writing, SiteKeepers Digital owns or retains rights to its business name, logo, brand assets, website content, service descriptions, templates, processes, layouts, internal tools, documentation, design concepts, code libraries, and reusable materials.

Once the final payment has cleared and all agreed project fees have been paid, the client will generally receive ownership or usage rights for the final approved website content and website files created specifically for that client, excluding:

  • Third-party plugins, themes, fonts, images, libraries, and licences
  • SiteKeepers Digital's pre-existing tools, templates, systems, processes, and reusable components
  • Unpaid drafts, mockups, concepts, or rejected designs
  • Software or materials owned by third parties

If a website uses a plugin, theme, tool, or service under a SiteKeepers Digital agency licence, developer licence, or subscription, the client may need to purchase their own licence if they cancel their care plan, move to another provider, or stop using SiteKeepers Digital's support services.

You must not copy, reproduce, resell, republish, or misuse SiteKeepers Digital content, branding, designs, templates, documents, or materials without written permission.

Portfolio Use

Unless you request otherwise in writing, you allow SiteKeepers Digital to mention your business name and display screenshots, links, or a general description of completed work in our portfolio, proposals, social media, marketing, or case studies.

We will not intentionally publish confidential information, private login details, sensitive business data, or non-public internal information.

Confidentiality

Both parties may receive confidential information while working together.

We will take reasonable steps to protect confidential client information and will not intentionally disclose it except where required to provide services, use trusted third-party providers, comply with law, or protect our rights.

Clients must also keep confidential any private pricing, proposals, technical documentation, credentials, processes, or non-public information provided by SiteKeepers Digital.
